Background Article 1

In the early 1990s, James Kimball founded Discovery Experimental & Development Inc. (DEDI) using his life savings. After years of directing other businesses via his morals and ethics, he finally had the opportunity to open a company dedicated to saving lives and helping people. Mr. Kimball played the most major roll in the company, directing it through the most difficult times. His courage was instilled in DEDI's employees while they directly suffered from the tactics of multi-billion dollar pharmaceutical special interests.

After DEDI developed Liquid Deprenyl Citrate, they began to have problems with pharmaceutical special interests. LDC (the only Selegiline in the world) had the ability to shelf all Parkinson's drugs and depression drugs. It also posed a severe threat to drugs used for fatigue, blood pressure, stroke, sexual dysfunction, and much more. The pharmaceutical interests started with attempting to convince Mr. Kimball to take LDC off the market. Mr. Kimball was receiving offers for the rights to LDC in the tens of millions (please know Mr. Kimball made less then $1 million profit throughout DEDI's entire existence).

Purchasing the rights to LDC would have been the best business move for pharmaceutical interests. They would spend, let's say $100 million, to ensure the safety of tens of billions. Mr. Kimball knew if he sold LDC rights, LDC would be shelved and would never be on the market. He did not sell out the consumers, or DEDI's customers, and rejected the offers made by the pharmaceutical special interests, clearly stating (in a meeting with Somerset's president) that a person's life has no price.

The multi-billion dollar pharmaceutical special interests turned to their only other option: Using their influence / power to take LDC off the market, and hopefully shut down DEDI. It was more of a war, where Mr. Kimball focused on progressing DEDI, yet defended the company whenever the special interests attacked. In order to attack effectively, the primary multi-billion dollar pharmaceutical company that wanted LDC off the market opened their second U.S. office, coincidently, down the hall from Mr. Kimball's corporate office. From that position, they oversaw all that came after, like listless government investigations, inspections, numerous indictment attempts for outrageous charges, etc.

The most powerful tool special interests had was the ability to influence FDA raids. During these raids, the FDA could confiscate anything they wanted to if they officially stated, "it's for our investigation". They would steal (as LDC customer's called it) all of DEDI's LDC, bottled or otherwise. They took files, computers, lab equipment, etc. DEDI would not see most of it for years, and what they did eventually get back would be damaged. The FDA never returned the LDC, even though it was never used to file charges or as any type of evidence. Further, the FDA and other government agencies would confiscate LDC customer's cash payments out of DEDI's mail box as a DEDI employee picked it up. The money would never be returned to DEDI. Yet, despite being robbed of the LDC, essential (and expensive) lab equipment, and money to pay for LDC, DEDI still honored all orders.

The pharmaceutical interests attempted to break DEDI with it's raids. However, DEDI's head doctor was so extremely ethical, honest, and caring, that he'd donate time (if he had to) to restock DEDI's LDC supply. Some of DEDI's employees would donate their time to re-bottle & label the LDC. In the end, pharmaceutical interests realized it would take more then trashing DEDI and stealing it's resources to shut them down. They also realized their power did not go as far as they hoped, as they discovered (after trying to influence the DEA) the FDA would be the only federal government agency where they had friends. Since DEDI was DEA licensed, the DEA could go into DEDI and inspect DEDI whenever they wanted. After initial inspections, the Tampa DEA learned of DEDI's morals, honesty, and compassion. They would never do anything to hurt DEDI.

Pharmaceutical companies will always have friends in the FDA because the FDA controls our medical industry. And if the pharmaceutical companies want to do all they can to ensure their billions continuously increase (or at least remain constant), they'll have friends in the FDA. Actions similar to the one raid detailed above would go on for almost a decade. Yet, DEDI still managed to develop new products, work with new scientists, conduct new research etc. Special interests worked to undo everything DEDI did to progress public knowledge of the company and it's products. With few popular news stations and no internet, it wasn't so difficult for the special interests. Furthermore, if special interests found out a doctor in charge of a lab was helping DEDI with research, they would influence the lab / institute / university superiors, who would in turn order the doctors to immediately stop. Anyone helping DEDI had to keep their help secret until the research was complete.

After a decade, pharmaceutical interests managed to classify LDC as a prescription drug, despite the scientific fact it is a botanical, despite the fact our laws define it as a "dietary supplement". What was involved to attain this classification would probably make anyone reading this sick, but the point is, after 10 years, they finally classified LDC as a prescription drug. If Mr. Kimball sold LDC, he could now be charged with, "selling a prescription drug without a prescription" (but, as you can see in the LDC customer reports, some customers had prescriptions). After DEDI stopped offering LDC, people would call Mr. Kimball either crying, begging, or pleading for the product because they needed it to survive or live a normal life.

Mr. Kimball, who offered LDC to save lives and help people in the first place (as the price of LDC alone proved), made the decision to offer LDC legally. It was certainly legal for U.S. citizens to order LDC from Mexico. In transitioning to the new LDC order system, DEDI showed it's innovation as one of the first company's to offer an automated phone system. This system, located in Mexico, would take orders for LDC. At this point, the pharmaceutical interests decided to "take off the gloves". Three multi-billion dollar pharmaceutical companies teamed up to take DEDI down.

In order to save time and keep this article's length reasonable, we'll detail the essentials: DEDI was involved with DSHEA (a congressional act) - the congressman who helped introduce DSHEA sent it to DEDI and asked if there was anything to add and their opinion. DSHEA clearly defined all of DEDI's products as dietary supplements, and furthermore demanded supplement manufacturers be formally notified by the FDA prior to an indictment or charges being considered. DSHEA further demanded manufacturers a right to a hearing (if requested) prior to a complaint / indictment. In that way, the manufacturer would have the opportunity to cease production before any indictment could be attempted; and use the court system to appeal or file injunctions with the court to continue production.

In direct violation of DSHEA, U.S. Prosecutor Rubenstein ignored DSHEA and filed an indictment without any notification a complaint was even being considered. Of course, Mr. Kimball discovered all of this when the FDA (helped along by a list of government agencies) raided DEDI once again. Prosecutor Rubenstein & the FDA tried to cover up their direct violation of the law by sending Mr. Kimball a formal letter weeks after he received the indictment. Rubenstein was an excellent find by the multi-billion dollar pharmaceutical companies, he was a sick pathological liar, and was relieved as a prosecutor for lying under oath in a case shortly after Mr. Kimball's.

Mr. Kimball was indicted on the charges, "selling a prescription drug without a prescription" "lying to a government official" and "conspiracy to sell a prescription drug without a prescription". Mr. Kimball was charged with lying to a government official because when he was sending LDC, Silvicidal, & Vitamin C to England (out of the United States), on the form under "description" he wrote "dietary supplements". Based on that single event, he was charged with "lying to a government official".

Before trial started, Mr. Kimball was denied a defense attorney. People usually read this and must read it again, because nearly every American knows you have the right to a court appointed attorney if you can't afford one. The judge, Richard Lazzara, denied Mr. Kimball a court appointed attorney and forced him to represent himself. Mr. Kimball usually didn't get more then 4 hours of sleep during the trial. During the trial, the judge found a reason to throw out nearly all of Mr. Kimball's witnesses without any objection from the prosecution. In other words, he took it upon himself to throw out the witnesses.

Mr. Kimball was found guilty of the charges. The sentencing guidelines stated a maximum sentence of 6 months in federal prison. Keeping in mind Mr. Kimball had NO criminal record, at age 60, judge Lazzara sentenced him to 13 years in prison. The judge took it upon himself to add 12+ years to the sentence. Lazzara officially used "sentence enhancements" (highly controversial) to add the additional 12 years. It typically blows someone's mind to learn this happened in our country, in our U.S. courts, and no one knew about it. The news refused to cover the story. People usually say murderers get less time, and they are correct, especially when they have no criminal history.

The Last BOP Action Against Kimball
In 2005, James Kimball (Kimball) had been imprisoned for about 5 years. Kimball spent most of his time filing motions for his release, pursuing correctional officers who greatly abused their power, and helping prisoners who were dying because of horrible medical treatment. Bureau of Prisons (BOP) Regional Director R.E. Holt retaliated against Kimball for exposing horrible medical treatment at Yazoo FCI, resulting in an extreme intervention from higher-ups (including a mass transfer of prisoners in dire need of medical attention to a medical facility). Kimball, being kind, honest, truthful, and helpful whenever possible, earned unwavering loyalty from some inmates and guards. As a result of this loyalty, Mr. Kimball found a note from an officer on his bed, briefly describing the action Holt was taking against him.

According to the note, Kimball was to be transferred to Big Spring FCI (out of the southeast region entirely and even further away from his family) in west Texas - a prison known as the worst low security prison in the south central region. Multiple inmates transferred from Big Spring at different times (with consistent stories) detailed epidemics of Tuberculosis and Chicken Pox, sleeping in 3 story high open dormitories in beds less than 2 feet apart, and an air conditioner that remained out of operation countless times. Kimball's original website (managed by his 14 year-old son) immediately displayed Holt's plans, motives, and facts for public view. After this posting, after observing Kimball's knowledge of a BOP prison transfer, the entire Atlanta office and superiors were furious.

Kimball was NOT supposed to know the BOP planned to transfer him, much less where they were transferring him. Holt's superiors swiftly intervened once more. There was a mass transfer of Correctional Officers from Yazoo FCI and a mass amount of new Correctional Officers (COs) transferred to Yazoo FCI. Except, these new guards had previously worked at U.S. Penitentiaries, high security prisons, and even the ADMAX (the highest security prison in the U.S.). These new COs had been employed by the BOP for a long period of time; and spending time with the most violent, disgusting, and dangerous people in our country causes severe psychological effects. The mind-state of a CO will change, they will come to forget about rules, inmate rights, health needs, etc. And now these guards were at a prison occupied by petty drug dealers and non-violent criminals. Meanwhile, Holt and his superiors knew Kimball could not be transferred to Big Spring, but they still decided to transfer him to FCI Texarkana in eastern Texas.

Rescuing Jay Kimball
Kimball was still sent to the BOP south central region and to a prison very difficult to visit compared with Yazoo FCI in Mississippi, which was hard enough. Kimball, however, was able to contact a friend / former congressman (who had powerful friends) and explain all that had happened. After listening, Kimball's friend was enraged at what happened with Kimball, particularly Kimball's transfer, and contacted a powerful senator to discuss what could be done. The senator intervened on Kimball's behalf. He setup a meeting with top BOP echelon, who complied with the senator's request. The BOP officials ordered Kimball's immediate transfer to a prison camp close to his family.

Addressing the Family Damage
About 5 months after being at the camp, Kimball's wife became seriously ill and Kimball's 15 years-old son did not know what to do. Mrs. Kimball had developed numerous stress-related medical conditions after her husband was imprisoned. The most serious being Multiple Sclerosis (M.S.). Her health had been continually declining since Kimball's incarceration, to this final point where Kimball recognized his wife was dying. Rather then let her die, he walked off of the camp to care for her. The facility was of the lowest security, with few guards, and no fence. After simply walking off he was classified, "escaped".

Soon after Kimball left the camp in December 2005, Kimball took his wife to a hospital. The hospital discovered she had serious uterine / ovarian cancer and needed an immediate operation. After her operation, Kimball took her to the renowned Moffitt Cancer Center. With Kimball present, the doctor at Moffitt told Mrs. Kimball that she had no more then 7 months to live.

Kimball's pharmaceutical company (DEDI) worked with various cancer clinics, and researched cancer. Kimball was highly involved with the research and knew of the most modern ways to treat Cancer and address the disease. With an exclusive DEDI product (LDC) that was used by cancer clinics and cancer patients, and limited mainstream methods, Kimball's wife was Cancer-free within 2 years. However, the Cancer had caused Mrs. Kimball's M.S. to progress rapidly. With Kimball's continuous efforts in the next year, it appeared Mrs. Kimball's M.S. was close to stabilization.

However, all this pressure had caused Kimball's own health to decline. He began to have difficulty breathing and soon suffered from great fatigue. Before walking off of the BOP camp, doctors found he had an aortic aneurysm, disintegrating gallbladder, and growths on his liver & kidneys. Kimball applied for Social Security to help support himself and his wife. But he mainly applied for Medicare health coverage, so he could afford a doctor and afford the necessary surgery. Kimball's 3 known medical conditions are deadly, and very deadly when they are all present as they are.

The United States Marshals
Kimball had been living a normal with his family for approximately 3 years. With all that our own government and special interests had done to him and his family, he did not have very much money. He was able to afford a trailer in a nice community in Leesburg, Florida (not a 60+ retirement community). There, he fixed the trailer up and made a living by mowing lawns and doing odd jobs around the community. His wife, who required his constant care, stayed with him in this trailer. Her house has recently been officially foreclosed by the bank. Even though Mr. Kimball had no mortgage on the house, his wife spent money on flights every other week to Yazoo Mississippi, money staying weekends at Jessup Georgia when Kimball was moved to the BOP camp, and an outrageous amount of money on filing fees so Mr. Kimball could file motions for his release. All the money was nearly gone in the end.

The fees to only file motions took up a lot of money. However, back then Kimball did not know courts pay no attention to motions filed by an inmate (and not a lawyer). The courts would always find some immediate grounds to dismiss the motions. Most Americans are not aware courts behave differently when monitored by the American public. Regardless, as an American, Kimball did all he could in the present situation and tried to catch up on the time with his family that special interests had taken away. In order to avoid any problems, Kimball did not re-open DEDI or sell any of his company's products. For 3 years, he lived a normal life.

Out of nowhere, instead of hunting murderers, rapists, dangers to our American society, the U.S. Marshals broke down Kimball's unlocked trailer door, rushed in the trailer heavily armed, and found Kimball, age 70, in bed. Traumatizing Kimball's wife, they dragged Kimball out of the trailer and left, without a word.

Kimball now sits in Mcintosh County Jail in Darien, Georgia awaiting trial. His wife's health is once more on the decline, with new stress-related symptoms beginning to appear. His own health is declining, with the new issue of an unexplainable high-blood pressure along with his preexisting conditions. The Kimballs' son is supporting his mother, and living with her / taking care of her. That's the current situation and basic background information.

Something to Consider
It's possible good can come of this situation. The pharmaceutical interests haven't heard Kimball's name in over 8 years. Back then, anything Kimball did to progress public knowledge of DEDI and what was happening, special interests would undo. However, the internet was not around back then and the few news stations Americans watched could be easily influenced to ignore 1 story. But now, at this present time, everyone can tell their friends what happened with Kimball and DEDI with a simple e-mail or blog post.

The American support will easily secure Kimball's release and hold everyone accountable who allowed this to happen. For instance, as mentioned above, Kimball's prosecutor was held accountable when the right people discovered what he was. However, he was only held partially accountable because he still has a license to practice law. Furthermore, together, we can re-open DEDI, and once more establish a true American pharmaceutical company; except, this time, we can ensure the entire world knows it's there. Every American Kimball's son has talked to would love to come together for such a purpose. And opening a pharmaceutical company, uniting to save the American medical system, could be the start of so much more.

Background Information

Please note what Mr. Kimball did what has never been done by anyone else to our knowledge. People build up companies, websites, or products so they can sell the rights and become millionaires.

This is common practice with non-profit organizations, and the very reason American's cannot trust any non-profit organization, no matter what pictures they show you or what words they use. Whenever a non-profit organization becomes big, someone will want to be in control of the power that is produced from hundreds of thousands of dedicated members. The founder will always sell because the buyer will be outrageously wealthy and offer the right price. Many times no one will know about the sale.

The point is, those in control of nearly all non-profit organizations will sell their members out for the right price. It is for this reason American's have such a hard time trusting non-profit organizations. With Mr. Kimball's reaction to becoming an outrageously wealthy multimillionaire at the cost of the welfare of DEDI's customers, every reader should be able to tell why so many scientists were loyal to DEDI, and why all of DEDI's customers trusted the company to such an extreme extent.
