Original Court Case

DEDI's president was pursued by our government for ensuring a reliable supply of Liquid Deprenyl Citrate. In this trial, James Kimball was charged with Conspiracy to sell a prescription drug without a prescription AND making a false statement on a customs form (which our government defined as "lying to a government official", and which our judicial system allowed). This case is emotionally difficult for most Americans to follow.

Terrible things happened because of special interests and an un-American judge. The most serious of which were:

  1. Mr. Kimball being denied an attorney and forced to represent himself
  2. The judge taking it upon himself to ignore sentence guidelines and add an addition 12+ years to Mr. Kimball's sentence
  3. The denial of a trial by jury for charges not filed by our government.

Upcoming 2009 Case

DEDI's president is currently being brought up on charges concerning "escape" from custody for walking off a federal facility to live a normal life and take care of his family. The prosecutor and judge seem fair.

From our accounts, it seems the prosecutor does not want to put time into the charges against Mr. Kimball. Mr. Kimball wants to make a deal to attain house arrest for his remaining sentence so he can immediately go back to his family and take care of his wife. From his home, he can fight to overturn the original charges and anyone who's willing can support him in the fight.

We don't know how the prosecutor feels about the home confinement deal, as Mr. Kimball has a very strange public defender, who knows what Mr. Kimball wants yet won't ask the prosecuting attorney if he'll agree. Please click on the above link for more details about the case.
